Fire Risk Assessment – Scotland

If you are an employer or landlord, you are legally responsible for making sure your premises, employees and tenants are safe from fire – if you don’t implement a good safety management plan, fire hazards can be lethal. You need to carry out an annual fire risk assessment however, depending on the existing control measures, fire hazards or overall site risk to fire, it may be necessary that the fire risk assessment is reviewed more often than annually. You must record details of your findings to ensure you have the correct measures in place to keep everyone safe.

My business is in Scotland – what are my responsibilities?

The Fire (Scotland) Act 2005 and The Fire Safety (Scotland) Regulations 2006 are the main pieces of legislation governing fire safety in buildings in Scotland.

In Scotland, every employer has a duty to carry out a Fire Risk Assessment. This identifies any risks to the safety of your employees that could be caused by fire in the workplace.

What if I’m a landlord of Short Term Lets?

If you offer Short Term Lets in Scotland, one of the conditions of your licence is that you need to carry out a fire risk assessment that covers, but not limited to:

  • fire warning – heat, smoke and carbon monoxide alarms
  • records – labels, receipts or photographs – showing furnishings guests have access to meet the Furniture and Furnishings (Fire Safety) Regulations 1988
